Procedure for the purchase of real estate in Portugal

The lawyer will offer you particular ease of mind and security in property transfers by intervening at all stages of the transaction.

The sale of a property is done in two stages: the preliminary sale agreement, followed by the final deed of sale.

All the verifications on the property and the owners, as well as the preparation of the preliminary sales agreement will be carried out by the lawyer. It is therefore advisable to retain the advice of a lawyer from the outset, given the financial and legal implications involved in a property sale. It will also allow you to be represented, without the need for your physical presence during the various stages of the transaction.

We will accompany you and prepare everything necessary for the success of your acquisition, namely:

  • Preparing the costs breakdown for the property purchase (taxes, land registry, lawyers' fees, notaries' fees, bank cheques, among others);

  • Obtaining your Portuguese Tax Identification Number (NIF);

  • Preparing powers of attorney for your representation before the sellers, the real estate agency, the notary, and any other public or private entity or organization;

  • Verifying the identification of the property owners;

  • Obtaining the current property registration documents from the Land Registry and the Tax Office;

  • Checking the construction habitation license from the Town Hall;

  • Verification of the energy performance certificate and the property’s technical sheet;

  • Preparation and drafting of the Promissory contract of Sale, in Portuguese and English, including all negotiated conditions and obligations;

  • Representation before the Tax Office for the completion of the necessary tax declarations for the transaction;

  • Organising the documentation for the preparation of the final deed of sale at the notary's office, setting up the appointment for its signature, and notifying all the parties involved;

  • Registration of the deed of sale at the land registry and the Tax Office and obtaining the certificates of ownership in the new owners’ name;

  • Transferring the water, electricity and gas contracts in the new owners’ name.
